Terms of Service

These Terms of Service ("Terms") govern your access to and use of Cineva — the website, applications, and services that let you generate, edit, and export AI-assisted video (together, the "Service"), operated by Cineva ("we", "us"). By creating an account, joining the waitlist, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Cineva turns text prompts and reference media into generated video using third-party AI models, and provides tools to storyboard, compose, and edit that media. The Service is currently offered in an early-access phase: access is granted by invitation from a waitlist, and features may change, be interrupted, or be withdrawn as we develop the product.
2. Eligibility and accounts
You must be at least 13 years old (or the higher minimum age required where you live) to use the Service. Accounts and sign-in are provided through our authentication provider. You are responsible for the activity that happens under your account and for keeping your sign-in credentials secure. Notify us promptly at support@cineva.app if you suspect unauthorized use of your account.
3. Waitlist
Joining the waitlist expresses interest in the Service and does not guarantee access. We may grant, delay, or decline invitations at our discretion. Waitlist emails are used only to manage and communicate about your access.
4. Credits and payments
- Generation is metered in credits. Credits are consumed when you run a render, at the rate shown before you confirm it.
- Credits may be granted for free (for example, starter credits) or purchased in packs through our payment provider. Purchased credits are a limited, non-transferable, revocable license to use the Service — they are not money, have no cash value, and are not redeemable for cash.
- If a render fails on our side, the credits charged for it are returned to your balance automatically.
- Except where required by applicable law, purchases are final and unused credits are not refunded. Prices for credit packs and per-render costs may change; changes do not affect credits you already hold.
5. Your content
"Input" means prompts, scripts, images, and other material you submit. "Output" means video, images, and audio the Service generates for you. You retain ownership of your Input. To the extent permitted by applicable law and by the terms of the underlying model providers, we assign to you all of our right, title, and interest in the Output you generate. You are responsible for how you use Output, including verifying that your use complies with applicable law and does not infringe the rights of others.
You grant us a limited license to host, process, reproduce, and display your Input and Output solely to operate, secure, and improve the Service (for example, sending your prompt to a model provider and storing the rendered result so you can download it).
6. Acceptable use
You agree not to use the Service to create, upload, or distribute:
- content that sexualizes or exploits minors in any form — this results in immediate termination and, where appropriate, a report to the relevant authorities;
- content that is unlawful, or that promotes violence, terrorism, or self-harm;
- non-consensual intimate imagery, or realistic depictions of identifiable real people without their consent, including deceptive "deepfakes";
- content that infringes copyright, trademark, privacy, or other rights of any person;
- spam, malware, or material designed to deceive or defraud.
You also agree not to probe, disrupt, or reverse-engineer the Service, evade its safety filters or rate limits, resell access without our written consent, or use automated means to create accounts or farm credits. Prompts are screened by automated moderation, and we may refuse to run any generation.
7. Storage and retention of generated media
Generated media is stored so you can preview and download it, and is automatically deleted from our storage approximately 30 days after creation. Download anything you want to keep. We are not responsible for the loss of media that has expired under this policy.
8. Third-party services
The Service depends on third-party providers — including AI model providers, authentication, payments, and cloud infrastructure. Their availability affects ours, and Output is subject to the capabilities and restrictions of the model that produced it. We are not responsible for third-party services we do not control.
9. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if needed to protect the Service or its users. Where practical, we will notify you and, for paid credits unaffected by your breach, work with you on a fair resolution.
10. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI-generated content can be inaccurate, unexpected, or resemble other works; review Output before relying on or publishing it.
11. Limitation of liability
To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or USD 100. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
12. Indemnity
You will indemnify and hold us harmless from claims arising out of your Input, your use of Output, or your breach of these Terms, except to the extent caused by our own breach.
13. Changes to the Service or these Terms
We may update these Terms as the Service evolves. For material changes we will give reasonable advance notice (for example, by email or an in-app notice). Continuing to use the Service after changes take effect means you accept the updated Terms.
14. General
These Terms are the entire agreement between you and us about the Service. If a provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
